Condo Tenancy Agreements in Singapore: What the Standard Clauses Miss

The condo layer: four clauses to add

  1. MCST compliance clause. The tenant agrees to comply with the Management Corporation’s by-laws (renovation hours, waste disposal, pool/gym rules, pet policy). This binds the tenant to rules they never signed — state it explicitly so enforcement is clean.
  2. Registration clause. Landlord will register the tenancy and occupant particulars with the management office within X days of signing (7 is customary); tenant provides NRIC/passport copies for this purpose.
  3. Keycard & access. Number of keycards issued, replacement cost on loss (commonly $20–$100), and return obligation at move-out. Missing keycards are the most frequent deposit deduction.
  4. Carpark. Whether a bay is included, the monthly rate if separate, and that parking allocation is subject to MCST availability — never promise what the management office controls.

Is a condo tenancy agreement different from an HDB one?

The core clauses (parties, rent, deposit, term, stamp duty at 0.4% to IRAS) are identical. The difference is the condo layer: MCST by-laws bind the tenant too, and the landlord must register the tenancy with the management office, issue keycards, and allocate a carpark bay. A condo lease should state who handles each of these and by when.

Can a condo management office block a tenancy?

They cannot refuse a lawful lease, but they can refuse to register it — which practically matters, because an unregistered occupant may be denied keycard access and carpark privileges. MCSTs also set minimum-occupation rules (whole-unit rental, no room partitioning) that must be respected. Confirm your building's registration requirements before signing.

Who pays maintenance fees and sinking fund in a condo tenancy?

By default the landlord (owner) pays MCST maintenance fees — they are a cost of ownership, not occupancy. This is the convention and what most standard agreements assume. If the parties agree otherwise, it must be written explicitly; an oral "tenant covers maintenance" is unenforceable in practice.

What appliance/inventory clauses matter in condos?

Condos are typically fully or partially furnished with air-conditioners, built-in kitchen appliances, a washing machine/dryer, and a fridge. List each item with brand/condition, and state who pays for AC servicing (usually tenant for servicing, landlord for capital failure) and filter cleaning frequency. Disputes over "the AC was already broken" are the single most common condo rental conflict in Singapore.

Do I need a diplomatic clause for a condo lease?

If the tenant is a foreigner whose work pass could be transferred out of Singapore, yes — it allows early termination (usually after 12 months with 2 months' notice and 1 month's penalty) without forfeiting the deposit. It benefits both sides: the expat gets an exit, the landlord gets a tenant willing to commit to a full year.
