What Is the OPA (Official Permission from HDB)?
The OPA โ also called HDB's written approval or subletting approval โ is the official green light from the Housing & Development Board that allows an HDB flat owner to rent out their flat or individual bedrooms.
This isn't a nice-to-have. It's a legal requirement under Singapore law. Section 35(1) of the Housing and Development Board Act makes it clear: you must obtain HDB's written approval before renting out any part of your HDB flat.

Why the OPA Matters for Your Tenancy Agreement
Many landlords and tenants assume that as long as they sign a tenancy agreement, everything is above board. Not quite.
For Landlords
Without HDB approval, your tenancy agreement is technically unenforceable against HDB. If you're caught renting without approval, HDB can impose penalties ranging from fines up to $5,000 for a first offence, to compulsory acquisition of your flat for repeat or serious breaches. For Tenants
If your landlord doesn't have OPA, you could be ordered to vacate with very short notice. Your security deposit could be at risk, and you have no guarantee that the arrangement is legal. Always ask to see the HDB approval letter before signing any tenancy agreement.
Who Can Apply for OPA?
Not every HDB owner qualifies. Here are the key eligibility criteria:
- Citizenship: Only Singapore Citizens can rent out their entire HDB flat. Singapore Permanent Residents (PRs) can only rent out individual bedrooms, not the whole flat.
- Minimum Occupation Period (MOP): You must have lived in the flat for at least 5 years (the MOP) before you can rent out the entire unit. This applies to both BTO and resale flats.
- Flat type: 1-room and 2-room flats cannot rent out bedrooms at all. For 3-room flats and larger, you can rent out bedrooms provided you continue living there.
- No outstanding HDB debts: All loans, arrears, and fees must be settled.

Occupancy Caps: How Many Tenants Can You Have?
This temporary relaxation, announced jointly by HDB and URA in January 2026, extends the higher occupancy cap that was first introduced in 2024. After 31 December 2028, the cap for 4-room and larger flats reverts to 6 occupants.
The Ethnic Integration Policy (EIP) Quota
Even if you meet all the above requirements, you also need to check the Ethnic Integration Policy (EIP) quota for your block and neighbourhood. HDB maintains ethnic quotas to preserve racial harmony in public housing estates. If your block's quota for a particular ethnic group is full, you cannot rent to a tenant from that group, even if you have OPA approval.
